Terms and Conditions

These Terms and Conditions (“Terms”) become effective between Barefoot Vacation Travel LLC (“Agency”) and you (including all travelers on the same booking) (“you” or “Traveler”) upon your signature (electronic or written) or payment authorization, and remain in effect until terminated in writing by you or Agency.
These Terms are subject to change at any time without prior written notice. The current effective version of these Terms is located at https://www.barefootvacationtravel.com/terms-and-conditions/.
Definitions
“Agency” means Barefoot Vacation Travel LLC.
“Booking Services” means travel reservation and booking services provided to you by Agency.
“Lead Traveler” means you, acting on behalf of all Travelers on the same booking.
“Supplier” means any party who provides Travel Services to Travelers.
“Terms” means these Terms and Conditions.
“Traveler” means you and all Travelers on the same travel booking.
“Travel Services” means travel products and services provided to you by Suppliers, including hotel accommodations, air transportation, cruises, car rentals, tours, activities, and similar products and services involving any type of leisure, business, or other travel.
Travelers
You are the Lead Traveler, representing all Travelers on the same booking. You are responsible for sharing these Terms with all Travelers and providing Agency with written confirmation that all Travelers agree to these Terms.
You are responsible for understanding these Terms. Please read them carefully before accepting Booking Services or Travel Services. If you do not understand any part of these Terms, please: (1) confer with your legal counsel; and (2) contact Agency in writing to request clarification. You acknowledge receipt of Agency’s Travel Services Agreement, which refers to these Terms.
Agency Role
Agency is a travel agent who provides Booking Services to you. Agency acts solely as an intermediary between you and Suppliers. Agency does not own, operate, manage, or control any airline, cruise line, hotel, resort, tour operator, or other travel Supplier. Agency has no authority over Supplier operations, staffing, safety standards, pricing decisions, or cancellation and refund policies.
Because Agency acts as agent for Suppliers and does not have the right to control Supplier operations, primary liability for Travel Services rests with the Supplier delivering those services. Agency’s obligations are limited to the Booking Services described in these Terms.
Suppliers
Suppliers are independent companies who provide Travel Services to you. Suppliers operate under their own terms, conditions, and management. Your travel documentation identifies each Supplier responsible for providing your Travel Services. By paying for Travel Services, you consent to the use of those Suppliers.
All documentation, receipts, confirmations, and tickets issued are subject to the terms and conditions specified by the Supplier. Please read Supplier terms and conditions carefully. You are responsible for understanding and adhering to all terms imposed by any Supplier with whom you elect to deal, including payment of all amounts when due and compliance with Supplier rules and restrictions regarding availability and use of Travel Services.
You understand that any violation of any Supplier’s terms may result in denied access to Travel Services, cancellation of reservations, and forfeiture of any monies paid. If any such violation results in fees or penalties to Agency, you agree to cover such actual costs. Suppliers may require you to sign a liability waiver prior to participating in their Travel Services.
Suppliers are not subject to Agency’s control and are not employees, agents, representatives, or affiliates of Agency. Agency is not responsible for any Supplier’s breach of contract, failure to comply with any laws, or willful or negligent acts or omissions, which may result in delay, inconvenience, costs, loss, damage, injury, or death to Travelers or Travelers’ companions.
If a Supplier declares bankruptcy, it is not obligated to transport you or to provide refunds. It may continue to provide some or all Travel Services, or it may stop operations completely. Other Suppliers may, but are not required to, provide alternative Travel Services. Payments transmitted to Suppliers immediately become the property of Suppliers as required by law. Agency is not permitted to provide refunds for Suppliers who have declared bankruptcy. Agency has no special knowledge about the financial condition of Suppliers and has no liability for recommending a trip credit or a refund.
Rates and Inclusions
Quoted rates are based on the precise inclusions Agency will provide to you in writing. Unless specifically itemized on your travel documentation, rates do not include Travelers’ costs, fees, or taxes incurred for or related to:
Airports, ports, stations, security, agriculture, customs, immigration, visas, passports, or any other government-imposed taxes or fees, without limitation; or
Meals, beverages, alcohol, minibars, entertainment, seat assignments, upgrades, excursions, hospitality, gratuities, telecommunications, energy, laundry, cleaning, bedding, parking, valet, insurance, taxis, transfers, porterage, departures, travel segments, health, medical tests or treatment, vaccinations, pharmaceuticals, supplements, or any miscellaneous charges of a personal nature, without limitation.
Personal Information
You consent to Agency and Supplier use of your personal information as necessary to provide Booking Services and Travel Services. You understand that, as part of booking any Travel Services, certain personal information may be conveyed to Suppliers to accommodate your travel. Such information includes dates of birth, passport numbers, government-issued identification details, travel dates, frequent traveler program numbers, and other information required to secure travel arrangements.
Agency will not be liable for the distribution of your information to any Supplier for purposes of completing your travel arrangements. Agency’s liability for the failure of any Supplier to protect your personal information is specifically excluded once that information has been transmitted to the Supplier for booking purposes.
You authorize Agency to retain your personal information for as long as needed to provide Booking Services and for a reasonable period thereafter for Agency’s legal or business purposes. Social Media and Image License
By accepting these Terms, each Traveler grants to Agency an unrestricted, royalty-free, non-exclusive, worldwide license to use, in Agency’s discretion, Traveler’s name, image, and likeness, including any photo or audio or video recording, relating to a trip for marketing, promotion, tagging, or any other lawful purpose on social media platforms, online locations, and Agency’s website.
If you do not wish to grant this license, please notify Agency in writing prior to your trip at legal@bvt.travel. Agency will make reasonable efforts to honor opt-out requests, but cannot guarantee that images already published prior to receipt of a written request will be removed from all platforms.
Groups
Terms for groups will differ from Flexible Independent Traveler (FIT) guidelines. For details, see your Group Sales Contract. The Group Sales Contract, when executed, is incorporated into and forms part of these Terms with respect to group bookings.
Reservations and Payment
You authorize Agency to collect your payment authorization details for the purpose of completing your travel booking with Suppliers. By providing your payment authorization details through Agency’s payment authorization platform, written documentation, or by phone, you understand and agree to these Terms, including all cancellation policies.
Agency does not process payments directly or charge client payment methods independently. When payment is required, Agency collects your payment authorization details and enters them manually into each Supplier’s booking system to complete your travel arrangements. Payment authorization details are stored securely in Agency’s client management system for up to 30 days consistent with standard payment authorization windows. Agency does not retain full credit or debit card numbers beyond the authorization window.
Traveler payments to Suppliers in currency other than U.S. Dollars (USD) will be converted at then-current exchange rates. Agency payments to Suppliers will be converted at then-current exchange rates between USD and the currency in Supplier’s country.
A purchase is not complete until all deposits and other amounts due have been processed and a booking confirmation has been provided to you in writing. If payments are not received by their due date, all components of the booking may be cancelled by the Supplier, which may result in non-refundable previous payments. Agency is not responsible for Supplier fare increases, fees, or penalties incurred due to late payment, all of which must be paid by you.
Agency reserves the right to cancel your booking if Agency does not receive full payment authorization for Booking Services or Travel Services within a reasonable time, in Agency’s sole discretion. If rebooking is requested, Agency will assist with obtaining any refunds due to rebooking trips (for example, using future cruise credits) at no charge to you.
Changes, Cancellations, No Shows, and Refunds
Changes and Cancellations
You agree to adhere to the terms and conditions of Suppliers regarding your travel reservations or bookings and you agree to pay any applicable change or cancellation fees imposed by Suppliers. If you change or cancel a reservation or booking, you may be subject to Supplier fees, charges, or penalties. Agency does not charge its own fees for changes or cancellations.
NO REFUNDS will apply to any cancelled, unused, or partially used Travel Service, subject to Supplier terms and conditions. Hotels may not permit changes to or cancellation of reservations, subject to the terms and conditions of the hotel reservation.
No Shows
Failure to travel or show up for any reservation or booking is considered a “no show.” No show penalties will be up to the entire cost of travel, subject to the terms and conditions of Supplier and Agency policies.
Refunds, Chargebacks, and Adjustments
Any claim for refund or adjustment must be sent to Agency in writing. Full details and proof of payment documentation must accompany all claims. You may not be entitled to a refund if you change or cancel your travel plans after: (1) a confirmation of the booking; or (2) payment of a booking. Refunds are subject to Supplier terms and conditions.
Suppliers may not issue refunds for cancellation due to actual, threatened, or fear of potential terrorist events, political unrest, pandemic or health concerns, or similar circumstances. Please carefully review Supplier terms and conditions.
You agree not to initiate a chargeback, reverse charge, or payment recollection with respect to any Supplier-imposed cancellation penalties or fees that have been transmitted to and retained by a Supplier, except in cases of documented fraud. This limitation applies because Agency does not retain Supplier payments and cannot issue refunds on a Supplier’s behalf. Nothing in this section waives any statutory chargeback or dispute rights you may hold under applicable state, federal, or provincial law that cannot be waived by private contract. If you believe you have a valid dispute, please contact Agency in writing at legal@bvt.travel before initiating any chargeback so Agency can assist in pursuing a remedy with the Supplier on your behalf.
If you initiate a chargeback, reverse charge, or recollection of a travel payment in violation of this section, Agency has the right to recover actual costs, fees, and expenses associated with such action, including reasonable attorney fees, to the extent permitted by applicable law.
Travel Documents and Entry Requirements
Traveler Identification
The Transportation Security Administration (TSA) requires all airline passengers to provide Secure Flight Passenger Data (SFPD), including full name as it appears on government-issued identification, date of birth, gender, and redress number (if available). The name of Travelers on all reservations and travel documents must match the name as it appears on that Traveler’s government-issued identification. Traveler is responsible for any fees and expenses that may be incurred due to an incorrect name or the denial of travel resulting from incorrect information. Updated information regarding security measures and requirements for air travel is available at www.tsa.gov.
Passports, Visas, and Documentation
All U.S. citizens traveling to or from any international destination must have a valid passport, which must be valid for at least six months beyond Traveler’s date of return. Travelers are responsible to confirm current entry and exit requirements and to obtain the necessary travel documentation based on the country of origin, destination, and stops in any additional countries. Agency may be able to assist Travelers in acquiring the necessary travel documents upon request. However, Agency is not responsible or liable for Traveler’s failure to obtain or provide required travel documentation or to determine the validity of any passport or other travel document.
Minors age 17 and under traveling alone or with a single parent may be required to have additional documentation on domestic or international flights. NO REFUND will be issued for any costs or losses incurred as a result of Traveler’s failure to obtain or provide required travel documentation.
Entry Refusal
Countries may restrict entry for persons with criminal records. You are responsible to understand all destination entry laws and to know if you or anyone in your party has a criminal record that may affect entry. Agency does not inquire about Traveler criminal records in the interests of privacy. Refusal of entry is not a valid reason for cancellation, chargeback, or refund.
Health Advisories and Travel Disruptions
You are solely responsible to be fully aware of any restrictions related to pandemics, epidemics, health emergencies, natural disasters, political instability, and other travel advisories that may affect your travel. You warrant that you have reviewed and understand all applicable U.S. Centers for Disease Control and Prevention (CDC) and U.S. Department of State travel advisories, notices, warnings, restrictions, and rules, including those regarding infectious disease outbreaks and other health threats that may affect your destination or travel route.
You are aware that certain countries, including the United States, may require testing, documentation, or quarantine upon entering or exiting the country. Requirements may change before, during, or after your travel without notice. Screening procedures and restrictions may take place at airports and in public areas, including mandatory health documentation, face coverings, or temperature checks.

Neither Agency nor Suppliers are responsible for Traveler testing, documentation, or compliance with any health or travel advisory requirements. You understand the inherent risks of choosing to travel and accept those risks. You hold Agency harmless against any travel restrictions, cancellations by Suppliers, financial loss, quarantine requirements, or measures put in place at airports or destinations you travel through, and you agree not to pursue any credit card chargeback, reimbursement, or legal action against Agency regarding Supplier-imposed penalties or fees arising from such events, except as otherwise provided in the Changes, Cancellations, No Shows, and Refunds section of these Terms.
Accommodations
Hotel accommodation is subject to availability at the time of reservation. Some hotels require non-refundable and non-transferable deposits to guarantee a booking. In such cases, Agency will notify you regarding the non-refundable pre-payment for that portion of your travel.
Amenities such as elevators, air conditioning, bedding size, and similar preferences are not guaranteed at all properties. Even if a property has such amenities, they are not guaranteed to be operational or available during your stay. Reimbursement for lack of amenities is solely the responsibility of the hotel. Agency may elect to act as an intermediary but is not responsible for such reimbursement under any circumstances.
Air Travel
Most airlines consider a name change to be a cancellation. You are responsible for excess baggage fees. Travelers are responsible to confirm airline baggage allowances for all flights. International flights may have different requirements than domestic flights. Tickets of any kind are payable in full at the time of booking. Airline tickets, once purchased, may be non-refundable and non-exchangeable, subject to airline terms and conditions.
Agency is not responsible for any loss, accident, injury, delay, defect, omission, or irregularity that may occur due to changes, additional expenses, and cancellations arising from weather conditions, schedule changes, and other changes beyond Agency’s control. You agree to adhere to safety guidelines of all airlines and hold Agency harmless from any liability due to airline restrictions.
Airline seat assignments are not complimentary on every airline. Pre-assigned seats selected in advance of flight time may be subject to additional fees. Agency cannot guarantee seats in specific locations or next to each other. Seat assignments are strictly based on availability at the time seats are selected and paid for. Airlines retain the right to change aircraft and seat assignments at any time. Agency is not responsible for any changes made by airlines or any additional charges imposed by airlines for changes to seat assignments after selection and payment.
Baggage and Personal Items
You are solely responsible at all times for your baggage, personal items, and travel documents. Agency is not responsible for any damage, loss, theft, delay, or other matters relating to your baggage, personal items, or travel documents, whether in transit, at any accommodation, or at any travel destination.
Baggage policies vary by Supplier and are subject to change. You are responsible for confirming current baggage allowances, size restrictions, and applicable fees directly with each Supplier before travel. Excess or oversized baggage fees are your sole responsibility.
Restricted Products and Materials
You are responsible for knowing, understanding, and complying with applicable laws in each jurisdiction in which you travel or transit regarding possession and use of restricted or illegal products and materials, including: (1) animals and animal products; (2) plants, fruits, vegetables, and soil; (3) cultural artifacts; (4) alcohol; (5) tobacco and vaping products; (6) firearms and ammunition; (7) knives and cutting instruments; (8) weapons; (9) flammables and explosives; and (10) any other products or materials that may be restricted or illegal.
You are responsible for knowing, understanding, and complying with applicable laws in each jurisdiction regarding possession and use of drugs, substances, and related paraphernalia, including prescription, over-the-counter, and other products that may be restricted or illegal in some jurisdictions but permitted in others. Local laws may require you to carry documentation from a qualified physician for prescription medications.
All air passengers are prohibited by federal law from bringing hazardous materials aboard aircraft in their luggage or on their person. Violations can result in up to 10 years of imprisonment and significant fines under 49 U.S.C. 5124. Restrictions on hazardous materials are listed at https://www.tsa.gov/travel/security-screening/whatcanibring/all. Some foreign airports require treatment of passenger cabins with insecticides prior to or during flights. The U.S. Department of Transportation provides a list of such requirements at https://www.transportation.gov/airconsumer/spray.
Possession or use of restricted materials or prohibited substances may result in immediate termination of Travel Services and detainment, prosecution, or incarceration by government authorities. Agency is not responsible for any consequences arising from Traveler’s failure to comply with applicable laws in any jurisdiction. Local rules change frequently; we strongly recommend checking current U.S. Department of State travel advisories at https://travel.state.gov before departure.
Traveler Conduct
You are responsible for your conduct and the conduct of all Travelers on your booking throughout the duration of your trip, including before, during, and after Travel Services. You are responsible for any damage or loss caused by your acts or omissions and agree to pay all such costs directly to Agency or any third party.
Any Supplier or authorized party may, in its sole discretion, refuse you any Travel Service, require you to leave any Travel Service, or require you to disembark any mode of transportation if the Supplier or authorized party reasonably believes: (1) you are a danger to yourself or any other person; (2) you have engaged in, are engaged in, or are threatening to engage in behavior that is disruptive, verbally or physically abusive, obnoxious, harassing, discriminatory, or otherwise contrary to applicable law or the comfort and safety of other travelers; or (3) you have failed to follow any rule, procedure, or instruction of the Supplier or authorized party.
If you are subject to any such action by a Supplier: (1) you may be left at any location, city, port, or place where the mode of transport stops; (2) you will be solely responsible for all costs relating to your subsequent transportation, accommodation, and subsistence; (3) you will not be entitled to any refund, in whole or in part, for Travel Services not used as a result; and (4) Agency will have no direct or indirect liability of any kind relating to Supplier decisions arising from Traveler conduct.
Agency is not responsible for any costs, losses, or consequences arising from Traveler conduct. This section survives termination of these Terms.
Disabilities and Special Needs
If you have disabilities or special needs that may require non-emergency special services, additional support, or disability accommodations, please advise Agency in advance of booking. If you are unable to use your own wheelchairs, mobility devices, or other medical equipment or devices, rentals may be available, potentially subject to additional charges.
Airlines and other Suppliers may impose charges for additional baggage and may have size restrictions for wheelchairs they can accommodate. If you travel with a service animal or emotional support animal, Suppliers may require advance arrangements and documentation regarding the animal’s health, training, and related factors.
Countries outside the United States and Canada often apply different laws, rules, regulations, standards, and accommodations for persons with disabilities or special needs. Travel destinations may have limited medical facilities, limited availability of prescription medications, and limited means to accommodate your disability or special needs. Please consult your health provider prior to planning or booking your travel.
Agency strongly recommends the purchase of comprehensive travel insurance, which may provide access to emergency medical care, medical evacuation, and replacement of prescription medications. Agency will make all reasonable efforts to request assistance or arrange for appropriate services or equipment regarding Traveler disabilities or special needs. However, Agency is not responsible for the failure of Suppliers to meet Traveler needs and expectations.
Food Allergies
If you or any Traveler on your booking has food allergies, dietary restrictions, or any similar condition that may cause harm during travel, please advise Agency in advance of booking so Agency may communicate your needs to Suppliers.
Each Traveler with food allergies acknowledges: (1) that there is an inherent risk of reactions, delays, or disruption during travel that Agency cannot eliminate; (2) that Agency does not guarantee the availability, accuracy, or sufficiency of allergen accommodations by any Supplier; and (3) that each Traveler bears sole responsibility for performing due diligence regarding their food allergies before, during, and after travel, including direct communication with Suppliers about ingredients, preparation methods, and cross-contamination risks.
Agency is not responsible for any harm, loss, or cost caused by any food allergy under any circumstances. This section survives termination of these Terms.
Health, Safety, and Risk
Risk Activity
If you engage in any activity that may involve risk of harm to your own or another person’s health or well-being, damage to property, or related costs (collectively, “Risk Activity”), you are solely responsible for your decision to engage in and your involvement with such Risk Activity.
Risk Activity includes any activity or travel to any location that can reasonably be regarded as inherently dangerous, hazardous, or otherwise having the potential to result in: (1) damage to or loss of any property; or (2) injury, disability, illness, or death of any person. Examples include but are not limited to zip lines, water sports, ATV tours, hiking, snorkeling, scuba diving, and off-road excursions.
You assume all risks, costs, losses, liabilities, and claims relating to any Risk Activity. You release Agency from all liability relating to any Risk Activity and will not pursue any claim against Agency in connection with such activity. Suppliers may require you to sign an additional liability waiver prior to participation in any Risk Activity.
Illness and Injury During Travel
If you become ill or injured during a trip, you bear full responsibility for your own well-being and for all costs, planning, and logistics regarding any alternative travel arrangements that may be required as a result. You will not cause unreasonable delay or interruption to any trip or impose upon other Travelers in connection with your illness or injury.
You release Agency, Suppliers, and other Travelers from any liability relating to your illness, injury, missed flights or connections, travel delays, or unused bookings that arise from your health condition during travel. Agency strongly recommends that each Traveler purchase comprehensive travel insurance that includes medical coverage and emergency medical evacuation. Agency is not responsible for the availability or adequacy of medical facilities at any travel destination. Travel destinations outside the United States may have limited medical resources. Please consult your physician prior to booking travel if you have any medical condition that may be affected by your destination or the nature of your travel.
This section survives termination of these Terms.
Travel Insurance
Agency strongly recommends that each Traveler purchase comprehensive travel insurance. If you decline to purchase travel insurance that includes coverage for medical needs while traveling and coverage for travel delays, you assume all personal risk and financial loss if you cancel your travel or incur costs or losses during the course of travel.
You understand that concerns or fear of health threats are not a covered reason under some travel insurance policies. Insurance policies may exclude coverage for certain health-related events. Insurance claims will only be paid for covered matters, as stated in the insurance policy. You hold Agency harmless for your election not to purchase travel insurance and for any denial of any claim by any insurer for any reason.
Force Majeure
No failure or delay in the performance of any obligation under these Terms will constitute a breach if such failure or delay arises from a cause beyond the reasonable and foreseeable control of Agency, including without limitation acts of God, floods, weather conditions, fires, explosions, accidents, war or threats of war (declared or undeclared), acts of terrorism, sabotage, insurrection, riots, strikes, civil disobedience, sickness, epidemics, pandemics, quarantines, government interventions, defects in machinery or vehicles, or other similar events beyond Agency’s control (collectively, “Force Majeure”).
Agency is not liable to you and will not provide any refunds for delay or non-performance of Agency’s own obligations under these Terms to the extent any such delay is due to a Force Majeure event. This limitation applies solely to Agency’s own performance obligations and does not affect your rights against Suppliers under Supplier terms and conditions.
If any Supplier is affected by a Force Majeure event, that Supplier may, in its sole discretion, vary or cancel any itinerary or arrangement in relation to your travel without notice. In such circumstances, Agency will make reasonable efforts to assist you in pursuing any refund, credit, or alternative arrangement available from the affected Supplier, though Agency cannot guarantee any particular outcome and is not financially responsible for Supplier decisions.
If an accident or disruption occurs during travel and you seek assistance from Agency, you will be financially and otherwise responsible for all alternative travel arrangements, subject to any refunds or credits recovered from Suppliers on your behalf.
Limitations of Liability
Because Agency acts solely as a booking intermediary and does not own, operate, or control any Supplier, primary liability for Travel Services rests with the Supplier delivering those services. Agency’s liability, if any, is limited strictly to Agency’s own acts or omissions in performing Booking Services.
Subject to the carve-outs described below, any recovery by you from Agency arising from Agency’s own acts or omissions in performing Booking Services is limited to the amount of commissions or fees actually received by Agency for the specific booking directly at issue.
Agency has no liability for any loss, injury, damage, delay, or other claim arising from the acts, omissions, negligence, or default of any Supplier, regardless of whether Agency recommended that Supplier. Agency disclaims any liability whether based on contract, tort, strict liability, or otherwise for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from Supplier acts, omissions, or failures, including without limitation failure to deliver Travel Services, cancellation and refund policies, fuel increases, bankruptcy or cessation of operations, and any other matters outside of Agency’s control.
Notwithstanding the foregoing, nothing in this section limits Agency’s liability for: (1) Agency’s own gross negligence or willful misconduct in performing Booking Services; or (2) personal injury caused directly by Agency’s own negligent acts or omissions, to the extent required by applicable law in the jurisdiction governing the claim.
All other representations or warranties, express or implied, are excluded to the fullest extent permitted by applicable law.
Arbitration
In case of a dispute between you and Agency relating to or arising out of these Terms, the parties will first attempt to resolve the dispute personally and in good faith. If those personal resolution attempts fail, the dispute will be submitted to binding arbitration, subject to the exceptions and provisions below.
The arbitration shall be conducted by a single arbitrator under the following terms:
Venue: The arbitration shall be conducted in Lee County, Florida, or by remote or virtual means at the election of the non-Agency party, so that no Traveler is required to travel to participate.
Governing law: The arbitrator shall be bound by applicable federal law and the law of the State of Florida.
Scope: The arbitrator shall have no authority to add parties, vary the provisions of these Terms, or award punitive damages. The arbitrator shall not certify a class or consolidate claims.
Costs: Each party shall pay their own costs and fees unless the arbitrator determines that fee-shifting is warranted under applicable law.
Class action waiver: You and Agency each waive the right to bring or participate in any class action lawsuit, class arbitration, or representative action arising out of or related to these Terms or the Travel Services provided under them, whether in arbitration or in any court of law, to the fullest extent permitted by applicable law.
Canadian residents: If you are a resident of Canada, mandatory arbitration clauses and class action waivers may not be enforceable under the laws of your province or territory. Nothing in this section waives any rights you hold under applicable Canadian federal or provincial law that cannot be waived by private contract. Canadian residents who believe they have a claim are encouraged to contact Agency at legal@bvt.travel to attempt resolution before initiating formal proceedings.
Nothing in this arbitration section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm pending the outcome of arbitration.
Canadian Residents
If you are a resident of Canada, your personal information is handled in accordance with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. You have the right to access personal information Agency holds about you, to request corrections to inaccurate information, and to withdraw consent to Agency’s collection or use of your information subject to legal and contractual limitations.
If you are a resident of Quebec, you may have additional rights under Quebec’s Act Respecting the Protection of Personal Information in the Private Sector (Law 25). Agency does not use automated decision-making processes that produce significant effects on clients without human review.
Personal information collected from Canadian residents may be transferred to and processed on servers located in the United States and is therefore subject to United States law. By engaging Agency’s travel planning and booking services, you acknowledge this transfer and the applicable legal framework.
Nothing in the Governing Law or Arbitration sections of these Terms is intended to waive any rights available to Canadian residents under applicable Canadian federal or provincial consumer protection law that cannot be waived by private contract. Customer data is not shared with third parties for promotional or marketing purposes. Mobile opt-in and consent information is never shared with any third party for any purpose.

General
Amendments. These Terms may be amended only in writing by Agency. The current version is always available at https://www.barefootvacationtravel.com/terms-and-conditions/.
Assignment. You may not assign any right or obligation under these Terms without Agency’s prior written consent, which will not be unreasonably withheld or delayed.
Waiver. No forbearance or delay in enforcing these Terms will prejudice or restrict any rights of you or Agency. No waiver of a right will operate as a waiver of any subsequent right. No right is exclusive of any other right, and each right is cumulative.
Severability. If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted by law and the remainder of these Terms will remain fully in force. The unenforceability of any provision in one jurisdiction will not affect its enforceability in any other jurisdiction.
Relationship of Parties. These Terms do not create an agency relationship, legal entity partnership, joint venture, or employment relationship between you and Agency. You have no authority to bind Agency or incur any obligation on Agency’s behalf.
Notices. Notices under these Terms will be in writing and deemed given when sent to the receiving party’s email or other address provided for purposes of notice. Notices to Agency should be sent to legal@bvt.travel.
Counterparts. These Terms may be signed or accepted electronically in more than one counterpart; each will be an original. Counterparts together constitute a single instrument.
Governing Law. These Terms are governed exclusively by the laws of the State of Florida without regard to conflicts of law provisions, except to the extent that applicable law in the jurisdiction of a Traveler’s residence mandates the application of local law and that law cannot be waived by private contract.
Further Assurances. You and Agency will perform any additional acts as necessary to effect these Terms and will address together in good faith any unforeseen issues that arise under these Terms with a view to mitigating any material adverse impact on either party.
Entire Agreement. These Terms, together with the Travel Services Agreement, constitute the entire agreement between you and Agency and supersede all prior agreements, written or oral, between us regarding their subject matter.
